It allows for the title to be converted to the foreigner when land laws permit it. This effectively transfers all ownership rights to the foreigner. This method of acquiring property in Indonesia is largely discouraged due to the many pitfalls and lack of clarity.
Indirect ownership
Since Indonesian laws directly prohibit foreigners from owning land, some foreigners have designed ingenuous ways of ending up with some property. One common way is where the foreigner indirectly owns the land. He or she does this by signing an agreement with an Indonesian. The foreigner provides the funds to buy the property, but the land is registered in the name of the Indonesian. The downside tot his arrangement is that if the Indonesian national chooses to “jump” the agreement then the foreigner has no recourse in law.
